Please read thoroughly this document to avoid further misunderstandings and even termination of service!

In this document, "We" shall refer to Pandela.com and it's parent company Pandela, LLC. "You" is the person legally eligible to sign-up for services at Pandela.com.

Pandela.com shall provide its Services to You under these Terms and Conditions. These Terms and Conditions intend to protect both the integrity and liability of Pandela.com and the Customer.

AGE OF ELIGIBILITY

You must be at least thirteen (13) years of age to use any services at Pandela.com.   Those under the age of thirteen may not join Pandela.com.

PANDELA.COM HOSTING SERVICES

1. BANDWIDTH. Your bandwidth limits depend on the hosting plan you have signed for. Our Premium Hosting Plans come with 200GB of bandwidth. Our Free Hosting Plan comes with 4GB of bandwidth. Additional bandwidth is available, if You upgrade your current hosting plan. Please note that in case the hosting account exceeds its allowed bandwidth, it may be suspended, until the end of month. Your used bandwidth is reset to zero in the beginning of every month.

2. DOMAINS HOSTED. Panela.com hosting plans includes domain hosting. Each Premium Hosting Plan can host 3 domains or more, depending on the included plan features or promotions. Each Free Hosting Plan is limited to host only 1 domain name!

3. SUBDOMAINS. Pandela.com Premium Hosting Plans can host up to 1000 subdomain names, Free Hosting Plans allows creation of 5 subdomains.

4. DISK SPACE. Our Premium Hosting Plans come with 20,000 MB of disk space or more, depending on the included plan features or promotions. Our Free Hosting Plan comes with 150MB of disk space. Additional space is available, if You upgrade your current hosting plan. Please contact sales for more information.

5. E-MAIL ACCOUNTS. With our Premium Hosting Plans you can create up to 1000 Mail Accounts, Free Hosting Plan support only 5 Mail Accounts creation.

6. IP ADDRESS. Pandela.com Premium and Free Hosting Plans does not include dedicated IP Address, all websites/hosts resolves to the IP address of the server they are hosted on.However, if you need a dedicated IP address, you can order one. Please contact sales for more information.

7. MYSQL DATABASE(S).Pandela.com Premium Hosting Plans includes 100MB of MySQL database storage. Pandela.com Free Hosting Plans includes one MySQL database with 3MB storage space.

MULTIPLE ACCOUNTS

You can have as much Premium Hosting accounts as you need. You have the right of only one account with Pandela.com Free Hosting Plan. Every new account added by You will be deleted, unless you have a permission from representative of Pandela.com.

FILE TYPE AND SIZE LIMITS

The file type and size limits apply only for the Free Hosting Plan accounts. You can not host or upload files larger than 2MB, all files larger than that size, will be deleted from our server. Hosting of files with the following extension is also prohibited: avi,mov,mp2,mp3,mpeg,ram,asf,quota,vbs,shs,scr,exe,cmd,torrent,wmv,wma,rm,zip,rar,rbs, if found, they will be automatically deleted.

BACKGROUND PROCESSES

Pandela.com Premium Hosting Plans does offer running of background processes, called cronjobs or crontabs inside our control panel. Please note that, if needed, there might be some additional fees, according to the system resources your process it taking.

FREE DOMAIN NAME PROMOTION

Every 12 or 24 months Premium Hosting Account comes with a FREE Domain name with every registration or hosting plan upgrade! However, if you decide to use the money back guarantee option, the domain must by paid - $19.95 per year. Please contact sales for more information. Please note that the FREE domain can be obtained only upon the process of upgrade or registraion, not after that!

30-DAY MONEY BACK GUARANTEE

Pandela.com Premium Hosting Plans include a 30-day money back guarantee. If you are dissatisfied with your service for any reason, you will receive a full refund (minus domain name registration fee and overage charges) if you cancel your account within 30 days of the activation of your account.

FRAUD TRANSACTIONS

Do you suspect fraudulent activity or transactions on your Pandela.com account? If so, please contact our Support Staff through the Tickets System or using our Contact Form, they will promptly investigate and remedy your claim.

CANCELATION

If you want to cancel your account for any reason, please contact our Support Staff, they will handle your request. Please note that the money back guarantee applies only, if there are no more than 30 days from the time of your account creation.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the Pandela.com Hosting Services, you will not use the Pandela.com Hosting Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not attempt to gain unauthorized access to any Pandela.com Services, other accounts, computer systems or networks connected to any Pandela.com Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Pandela.com Services.

Pandela.com reserves the right at all times to disclose any information as Pandela.com deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Pandela.com sole discretion.

THIRD PARTY

Any dealings with third parties (including advertisers) included within the Pandela.com Services or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. Pandela.com shall not be responsible or liable for any part of any such dealings or promotions.

TERMINATION

You agree that Pandela.com, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service if you violate these terms.

YOUR RESPONSIBILITIES

You are solely responsible for the content of your messages. Using the Pandela.com Hosting Service in connection with pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or otherwise) is prohibited.

In consideration of your use of the Service, you agree to:

1. Provide true, accurate, current and complete information about yourself as prompted by the Service's registration form.

2. Maintain and promptly inform us to update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Pandela.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Pandela.com has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

3. You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.
You agree to:
- immediately notify Pandela.com of any unauthorized use of your password or account or any other breach of security
- ensure that you exit from your account at the end of each session.
Pandela.com cannot and will not be liable for any loss or damage arising from your failure to comply with this.

4. Pandela.com cannot and will not be liable for any website loss or damage. Please keep the backup of your site(s) on your computer and CD.

5. Any Customer in violation of system or network security is subject to criminal and civil liability, as well as immediate account termination. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, e-mail bombing, flooding deliberate attempts to overload a system and broadcast attacks. Forging of any TCP/IP packet header or any part of the header information in an e-mail or newsgroup posting.

6. Customer agrees not to publish on or over its account any information, software or other content which violates or infringes upon the rights of any others or which knowingly contravenes the laws of any jurisdiction in which such content is generally accessible.

7. Pandela.com does NOT allow sites that provide any content, points of distribution, or 'links' to sites that:
- infringe on any third party's intellectual property or proprietary rights, or rights of publicity or privacy;
- violate any law, statute, ordinance or regulation;
- are defamatory, trade libelous, threatening, unlawfully harassing, abusive, or obscene, including child pornography, and/or pornography of an incestuous nature ;
- contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another;
- contain Pirated or Hacking / Phreaking Software (Warez)- Any software that is copyrighted and not freely available for distribution without cost. ROMs, ROM Emulators and Mpeg Layer 3 files (MP3) all fall under this jurisdiction;

8. CPU Usage. The CPU usage on the web server, where every customer's account is hosted, is subject to some limits and regulations. Every customer's hosting account can not use more then 10% CPU Power for more then 180 seconds at any given time or 3% in the course of 24 hours. Please note that we may suspend every customer who, by overusing the CPU limits of his account, have impact on the other accounts hosted on the same web server or have caused disturbance of the web server's normal workflow. In such cases, the customer will be notified by e-mail, 2 days before his account is suspended. He must reduce the CPU load of his web sites or move his account to a semi-dedicated or dedicated solution. Pandela.com reserves rights to block files or scripts that use high CPU power and notify the customer.

9. Pandela.com Premium Hosting Plans offers a great amount of bandwidth and traffic. The customer must not allow other web sites or servers to hotlink files stored on their hosting account. The customer must not use his hosting account only as a file sharing service for (un)archived content, programs or sound files.At least 85% of all file content (including MP3,WAV, RAR,ZIP,SWF,JPG,GIF,TIFF, but not limited to these file extensions) in the customer's hosting account should be part of an active and working web site and should have a corresponding HTML or PHP file linking to it. If requested, every customer must provide a prove that a given file is a part of his web site and not only stored on his account.

SPAMMING IS NOT ALLOWED

We will determine in our sole discretion whether any of the messages you send are spam. For your information, spamming generally includes, but is not limited to:
- the bulk sending of unsolicited messages, or the sending of unsolicited e-mails which provoke complaints from recipients
- the sending of junk mail
- the use of distribution lists that include people who have not given specific permission to be included in such distribution process - posting commercial ads to USENET newsgroups that do not permit it
- posting articles containing binary encoded data to a non-binary newsgroups
- excessive and repeated posting off-topic messages to newsgroups
- excessive and repeated cross-posting
- e-mail harassment of another Internet Customer or Customers, including but not limited to, transmitting any threatening, libelous or obscene material, or material of any nature which could be deemed to be offensive
- the e-mailing of age- inappropriate communications or content to anyone under the age of 18.

COPYRIGHTS

Copyrighted material must not be placed on Customer's account without the permission of the owner(s) or person(s) they specifically authorize. Only the owner(s) or such authorized person(s) may upload copyrighted material to the account.

Upon our receipt of notice of a claimed copyright infringement containing the above information, after confirmation we will promptly remove the allegedly infringing material from the Services and carry out further procedures if necessary. We will have no liability to any Customer of the Services for the removal of any such material.

MISCELLANEOUS

I. Pandela.com cannot be held responsible for the content of pages hosted under our service. Pandela.com does not review pages for content before they are posted, and does not verify, endorse or otherwise take responsibility for the contents of any user-created pages. However, we reserve the right to remove any page from our servers which we determine is in violation of our rules and guidelines. Users are solely responsible for all files contained in their own directory, and can be held legally liable for the contents of their web site.

II. Pandela.com may terminate user accounts at any time, without notice for conduct that violates these guidelines, or for any other reason, and may terminate user accounts and delete any and all user information for conduct that Pandela.com believes is harmful to the business of Pandela.com, or any of its users or partners. Pages found in violation of these items may be subject to immediate deletion and removal from our servers, and their webmasters subject to banishment from the Pandela.com network. The following is a non-exclusive list of content and behaviors that are UNACCEPTABLE on a Pandela.com hosted website.
a. Content that contains or contains links to: nudity, pornography, adult content, sex, or foul language.
b. Content that condones, promotes, contains, or links to warez, cracks, hacks, their associated utilities, or other piracy related information, whether for educational purposes or not.
c. Content that has been promoted through the sending of unsolicited e-mail (spamming), inappropriate newsgroup postings, mail fraud schemes, or pages that promote or condone such activities. Users who utilize indmedica.com resources, including e-mail addresses for spam are also subject to prosecution to the fullest extent of the law.
d. Content that commits acts of copyright, trademark, patent, trade secret or other intellectual property infringement.
e. Content that is racist, or otherwise extremely offensive to others, including content which aggravates, harasses, threatens, defames, or abuses others.
f. Storage of log files or non-html content, or any use of space that circumvents the display of advertising.
g. Having password-only, hidden, or restricted access pages (all web pages must be accessible to the Internet community at large). If you are interested in private or password protected pages, please check out our upgrade options.
h. Sites that exploit images of children under 18 years of age.
i. Binary files, downloads, etc. that are not linked to an html page on the users site, such that an advertising banner is displayed. Links back to files on a user's Pandela.com page from other sites must also link first to an html page on Pandela.com, which then links to the binary files.
j. Sites that provide CGI proxy services, most of the time these sites are used by hackers/crackers to scam websites.

III. Pandela.com provides web space for hosting web pages but makes no implied or express warranties about the reliability of this space or related services. Pandela.com is not responsible for any deletion, alteration, or loss of data or business due to network or system outages, file corruption, accidental deletion, or any other reasons. Pandela.com makes no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such.
a. Users are responsible for regularly monitoring and creating backups of their own files, and agree to use the indmedica.com resources and infrastructure at their own risk. This service is provided on an as is basis without warranties of any kind, either expressed or implied. Neither Pandela.com nor its partners makes any warranty with respect to any content, information, services, or products provided through or in conjunction with this service.
b. Pandela.com and its partners make no guarantee of the accuracy, correctness, or completeness of any information on these web pages and are not responsible for any errors or omissions arising from the use of such information; any failures, delays, or interruptions in the delivery of any content or services contained on our servers; or losses or damages arising from the use of the content or services provided by Pandela.com.
c. Pandela.com may also link to or include on its web site resources and information provided by 3rd party partners and providers. We do not guarantee the reliability of this information, nor does the inclusion of this information imply our recommendation of these services; it is merely provided to assist you in the creation of your web site and provide added value to our service.
d. You agree to indemnify Pandela.com and its partners against any and all claims and expenses, including attorneys' fees, arising from the your use of this service. This expressly includes your responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and any libelous or unlawful material contained within your web site.

IV. Other Pandela.com rules and guidelines: a. Each user is responsible for building and updating his/her web page, and regularly backing up any related data. b. User accounts using the Free Hosting Plan, will be deleted after 90 days if there is no activity on the account, in order to free up unutilized resources. c. Pandela.com reserves the right to regularly communicate with members pertaining to their web site and other services, available products, news, and special discounts which may be of interest to members of the community.

V. Pandela.com reserves the right to amend or change these guidelines at any time without notice.

Except as expressly provided in a particular "legal notice" on the Pandela.com, these Terms and Conditions constitute the entire agreement between You and Pandela.com with respect to the use of the Pandela.com, and Content. Your use of the Pandela.com is also subject to the Pandela.com Privacy Policy.
